Definition

The percentage rate limit defines the percentage value in relation to the total value of a bill of material.
This value must not be exceeded by the cumulative value of all materials from the country of origin which are relevant for export control and subject to a legal regulation.
Otherwise, if you export goods into a country of this country grouping with this legal regulation, you need an export license for the main component of the bill of material.

Use

The percentage rate limit is used for checking bills of material in the area of legal control.

Specific legal regulations require not only a check for whether the materials are complete but also, under certain circumstances, a check of the main component of bills of material, even if the main component is not relevant for export control.

Example

For the US Export Administration Regulations (EAR):

A bill of material of a Japanese producer contains materials with country of origin 'US'. The materials are listed in the US Commerce Control List and have an Export Control Classification Number (ECCN).
The percentage value of US materials in relation to the total value of the Commerce Control List is 20%.

If this bill of material is to be exported, the US authorities issue a percentage rate limit, depending on the country grouping to which the country of destination for this export belongs.

  • If this 20% does not exceed the percentage rate limit, the main component does not require a US export license.
  • If this 20% exceeds the percentage rate limit, the main component requires a US export license.
