Definition

This indicator provides information on whether special features, that have to be considered for the different property relationships, such as de facto splitting or heritable building right, exist for loan processing and land charge entry.

De facto splitting

De facto splitting means that the object is on a property that was/is measured or divided by the survey office.

Division according to the condominium act

This division is possible for condominiums and terraced houses or duplexes and is documented by means of a notarial division declaration. In addition to the special right of use of the apartment or house, a shared investment in the common property with the remaining co-owners exists.

Heritable building right

With the heritable building right, the authorized person leases the property from the real estate owner for a certain period. The heritable building right is documented by means of a notarial document and is entered on a special land register page (leasehold land register). Consequently, the land value is unimportant for a collateral value determination of the object.

Ground rent to be paid to the real estate owner can be entered in section II of the land register as being a lease payment.
