Definition

The different maximum pension rate determines whether a maximum rate of 75% or 71.75% is applied when the pension percentage and pension payment are calculated to provide information to a family court.

Use

When information is provided to a family court in the case of divorce, a pension percentage is set and a pension payment is determined when calculating the pension equalization payment. The Pension Amendment Act 2001 requires the lower maximum pension rate to be applied in some cases.

If the end of the marriage is after the Eighth Adjustment of the December 31, 2002 law, then the lower maximum pension rate of 71.75% is generally used, irrespective of the selection.

Otherwise, if no different maximum pension rate is specified, the applicable maximum pension rate is determined as follows:

  • Subapplication VAVA is used to determine as of which date (end of marriage) the lower maximum pension rate of 71.75% is generally to be applied. If the end of marriage date lies after the defined date, a maximum rate of 71.75% is applied; the adjustment factor is not used.
  • Otherwise, the lower maximum pension rate of 71.75% is applied for active civil servants at the end of marriage, and the maximum pension rate of 75% is used for retired civil servants.
