Definition
If a pension equalization payment has been made at the expense of the salary recipient, a reimbursement procedure according to Section 225, Paragraph 1 or Paragraph 2 SGB VI is considered.
A reimbursement according to Section 225, Section 2 SGB VI is only possible if the monthly amount of the legally binding pension rights does not exceed the limit of 1 percent of the monthly reference value, as stipulated by law, that was valid at the end of the marriage.
The complex reimbursement procedure to Section 225, Paragraph 1 SGB VI, which usually takes a long time, is not used for these de minimus cases. Instead, only a one-off contribution must be paid to the pension insurance provider responsible by the insurance company, thus excluding subsequent reimbursements to Section 225, Paragraph 1 SGB VI.
