Definition
In this field, you specify whether the employee is excluded from ordinary notice of dismissal for an unlimited period of time.
Use
This question is also to be answered with #Yes# if the employee is excluded from ordinary notice of dismissal by law, by company agreement, or by individual contract.
Dependencies
Example
- An unlimited exclusion can occur if the employee can no longer be subject to ordinary notice of dismissal according to the collective agreement due to his or her age and long length of service and the collective agreement also does not permit any exceptions (such as termination due to social plan) that affect the employee and his or her last workplace.
- For example, the following are excluded from ordinary notice of dismissal for a limited period of time: works council members, personnel board members, severely challenged employees, employees on parental leave or maternity protection. If the termination occurs with approval of the authorities (for example, for severely challenged persons in accordance with Section 85 SGB IX), this has to be reported under 3.14.3.6 (#Reason for Canceling Unlimited Exclusion from Termination#).
- Authorization for fixed-term terminations for important reasons can be given if the company is shut down.
