Definition
If the baby is stillborn after the 25th week of the pregnancy (after the start of the 16th week before the Expected Week of Confinement), both Statutory Maternity Pay (SMP) and Statutory Paternity Pay (birth) are payable.
However, if the baby is stillborn before the 25th week of the pregnancy (earlier than the 16th week before the Expected Week of Confinement), Statutory Maternity Pay and Statutory Paternity Pay (birth) are not payable.
Note:
A maternity certificate (Form MAT B1) is not normally produced by a doctor or midwife before the 26th week of the pregnancy. In the case of a stillbirth, it should only be produced if the stillbirth occurs from the 25th week of the pregnancy.
Use
Set the Still birth occurred indicator if the baby is stillborn after the 25th week of the pregnancy. You must also enter the date that the baby was stillborn as the actual start of MPP date, or the actual start of PPP date.

Statutory Maternity Pay (SMP)
An employee has a MATB1 form issued on 01.07.2003 with a stated due date for the baby of 07.10.2003. The employee's Expected Week of Confinement (Childbirth) begins on 05.10.2003 and the Maternity Pay Period is calculated as 15.06.2003 - 05.10.2003.
The baby is stillborn on Sunday 15.06.2003, in the 26th week of the pregnancy. As SMP would be payable from this date, you need to set the Still birth occurred indicator and enter 15.06.2003 as the actual start of MPP date.
However, if the baby was stillborn on Saturday 14.06.2003 (25th week of the pregnancy), SMP would not be payable and the system would not allow you to enter this date as the actual start date of the Maternity Pay Period.
