Three locations are relevant in the ISS process:
- The location of the service provider
- The location where the service is provided
- The location of the service recipient
Each tax jurisdiction (município) can define:
- Certain cases for which ISS has to be paid to it (for service types, business partners, and other special exceptions)
- Which location is to be used for calculating the ISS due
Examples
Assume that for cleaning services, city ABC defines the location of the service provider as tax-relevant, but city XYZ defines that the location where the service is provided is relevant. If a service transaction involves these two cities, it is possible that both cities demand taxes.
