Definition
This is the date on which the baby was actually born.
Use
For employees intending to take paid Statutory Maternity Leave, the baby's date of birth is used as follows:
- If the baby is born before the Maternity Pay Period (MPP) is due to start, the maternity pay period would be the period of 26 weeks beginning from the Sunday following the date of birth.
- If the baby is born early but after the MPP has started, Statutory Maternity Pay is paid normally as if the baby had been born in the Expected Week of Confinement (EWC).
- If the baby is born late, after the EWC, the MPP is not affected.
For employees intending to take paid Statutory Paternity Leave (birth), the baby's date of birth is used as follows:
- If the baby is born before the Paternity Pay Period is due to start, the Paternity Pay Period would be a period of either one or two weeks beginning no later than 49 days following the date of birth of the child, or the first day of the EWC, whichever is the later.
- If the baby is born late, after the EWC, the Paternity Pay Period is not affected.
