Documentation
Definition
Specifies the respective laws, agreements, and regulations that apply to foreign trade in a specific country. Different legal regulations may be required for the different foreign trade processes in each country.
Example
The following legal regulations may apply in individual foreign trade areas.
- Import and export control
Legal import and export rules are mainly based on several regulations and laws. In the Federal Republic of Germany, the main legal instruments are the Foreign Trade Law ('Außenwirtschaftsgesetz' (AWG)) and the Foreign Trade Regulation ('Außenwirtschaftsverordnung' (AWV)). In the USA, export regulations are defined in the Export Administration Act (EAA) and the corresponding Export Administration Regulations (EAR).
- Transit procedures
Transit procedures are standardized and regulated Europe-wide. The corresponding legal regulation has the same name as the electronic system: New Computerized Transit System (NCTS).
- Customs procedures
Customs monitoring is the responsibility of the national customs authorities. In the USA, the legal regulation that governs imports and exports is the Automated Customs Environment (ACE), which covers automatic export procedures handled with the Automated Export System (AES), among other things. In Germany, the legal regulations for import and export procedures are the Customs Code ('Zollkodex' (ZK)) and its implementing regulation. They are named after the automatic customs processing system with the customs' own name; for example, ATLAS ('Automatisiertes Tarif- und Lokales Zollabwicklungssystem') for Germany. The Dutch equivalent is called Sagitta.
- EU preference processing
Conditions for preferential customs treatment are regulated in unilateral, bilateral, or multilateral preference agreements between the EU and partner states. They are collectively referred to as preference law.
- NAFTA preference processing
The North American Free Trade Agreement between the United States, Canada, and Mexico regulates the conditions for preferential customs handling between these countries.
- Restitution
The subvention payments made by the EU for CAP products are based on agreements within the framework of the Common Agricultural Policy (CAP). They are collectively referred to as restitution.
- Letter of credit processing
A letter of credit is an instrument that is used to level the interests of purchasers and vendors of goods. The "Uniform Customs and Practices for Documentary Credits" (UCP 500) from the International Chamber of Commerce, Paric (ICC)" form the contractual basis for letter of credit processing.
The legal regulation that applies in each case is determined for the combination of item and document in each case.
