Definition
The place of jurisdiction denotes the place of the court where legal disputes resulting from an inadequate fulfillment of a contract are settled.
The legal place of jurisdiction is the legal place of fulfillment.
A contractually agreed place of jurisdiction is only possible among full merchants and legal persons. They often agree the place of the vendor's headquarters. If one of the parties to the contract is not a merchant, the statutory provisions are applicable as a general rule.
This regulation exclusively applies to contracts concluded in Germany. For other countries, the legal provisions of the country concerned are applicable.
