Definition
A place of fulfillment (also called place of performance in the German Civil Code) is the place where the parties to the contract have to perform their obligations.
In the case of two contract parties, two places of fulfillment are permitted by law if the contract accepting party and the contract tendering party do not have the same place of residence. The contractual place of fulfillment can be any place.
This regulation exclusively applies to contracts concluded in Germany. For other countries, the legal provisions of the country concerned are applicable.
