Severance Pay According to §4 Para.4 VsorglastVteilStVtrG (Treaty on Sharing of Pension Costs)

Legal basis:

For fixed-term civil servants who would not have entered retirement when their employment period expired with their ceding public sector employer, a severance pay must be paid to the amount of the costs that would have been incurred for a retroactive pension insurance of the employment periods with the ceding employer in the statutory pension insurance if the employees had left the employment at the point in time of the change of public sector employer. If the ceding employer received a severance pay in accordance with this treaty due to an earlier change of public sector employer, the ceding employer must pay this amount to the receiving employer plus interest of 4.5% per annum from the point in time when the payment was received, in addition to the severance pay in accordance with clause 1. For soldiers serving for a fixed period, a severance pay is to be paid in accordance with clause 1, taking a contribution rate of 15% as a basis. (§4 Para.4 VsorglastVteilStVtrG)

Implementation in the system

In contrast to the severance pay in accordance with the treaty on sharing of pension costs in general, as described in the documentation German Treaty on Sharing of Pension Costs (Versorgungslastenteilungs-Staatsvertrag), the severance pay is processed for fixed-term civil servants in accordance with §4 Para.4 VsorglastVteilStVtrG as a process scenario within Administration for Retroactive Pension Insurance (transaction HRPBSDENV) and not in Pension Administration (transaction HRPBSDENA). From a technical and content point of view, the severance pay calculation for these cases in accordance with §4 Para.4 VsorglastVteilStVtrG is based on the process scenario Retroactive Pension Insurance with the Deferment calculation type. This is a prerequisite for the calculation of the severance pay.

Creation of the Retroactive Pension Insurance process scenario with the Deferment calculation type

If it does not already exist, create the process scenario Retroactive Pension Insurance with the calculation type Deferment and with the business scenario Administration for Retroactive Pension Insurance in the system for the affected personnel number.

For soldiers, in the Master Data for Retroactive Pension Insurance subprocess scenario on the Basic Data tab page in the Employment Type input field, select the entry Soldier Serving for a Fixed Period. Then you do not have to edit and release this process scenario completely; it is sufficient just to edit the two subprocess scenarios Master Data for Retroactive Pension Insurance and Entitlement Periods. In the Entitlement Periods subprocess scenario, you can set the process scenario to the overall status Released for Severance Pay using the Release for Sever. Pay pushbutton for soldiers whose current employment type identifies them as being soldiers serving for a fixed period. Similar to the real final status Released, this overall status allows the creation of a subprocess scenario Severance Pay Calculation (process scenario Severance Pay for Change of Employer with the business scenario Change of ER: Retroactive Pension Insur. see below), which can then reference the process scenario Retroactive Pension Insurance with calculation type Deferment and use its data as the calculation basis.

In the method IST_SOLDAT_AUF_ZEIT of the class CL_HRDEPBSVAVG_VLTSV_TOOLS, the system checks whether these employees are soldiers serving for a fixed period and then activates the Release for Sever. Pay pushbutton. The standard implementation of the method checks the input field Employment Type from the tab page Basic Data for the value '05' for soldiers serving for a fixed period. If you want to make a different check, you create a customer-specific enhancement in this method.

Creation of the process scenario Severance Pay for Change of Employer

Then create the associated process scenario Severance Pay for Change of Employer with the business scenario Change of ER: Retroactive Pension Insur.

Start Administration for Retroactive Pension Insurance (transaction HRPBSDENV) and open the overview display. Use the Create Infotype 716 pushbutton to create a new process scenario for the business scenario Change of ER: Retroactive Pension Insur.

Once the business scenario is selected, a dialog box appears in which you can enter additional information:

  • Process scenario
    Select the process scenario Severance Pay for Change of Employer.
  • Effective Date
    The current system date is proposed as the effective date. This date is used for the calculation of the severance pay amount.

Save your entries. The system then displays the input screen of the process scenario.

Subprocess scenario: Severance Pay Calculation

On the Severance Pay Calculation tab, enter the essential data for the calculation, starting with the severance pay period. In contrast to a severance pay due to a change of public sector employer in accordance with §2 Para.1 VsorglastVteilStVtrG, only the end date is ready for input here.

The Input Data group box is used to enter the data for the calculation. The fields Calculation Type, Reference to Process, and New PS Employer are display fields only and are filled by the system.
Additional information about the individual fields is provided below:

  • Output field: Severance Pay Period (Validity Start Date)

    The Validity Start Date of Severance Pay Period output field displays the start date of the retroactive pension insurance period of the associated retroactive pension insurance process scenario with calculation type Deferment.

  • Input field: Severance Pay Period (Validity End Date)

    In the Validity End Date of Severance Pay Period input field, the system proposes the end date of the retroactive pension insurance period of the associated retroactive pension insurance process scenario with calculation type Deferment. For soldiers serving for a fixed period who change their public sector employer before this proposed date, you overwrite this end date with the date of the change of employer, using the last day in the old employment relationship, which is typically the last day of the month.

  • Output field: Calculation Type

    In the output field Calculation Type, the system displays whether this is an initial calculation or a retroactive calculation. This field is dependent on the subsequent output field Reference to Process, as this is an initial calculation if a retroactive pension insurance process scenario with calculation type Deferment is displayed in the field Reference to Process. The calculation type Retroactive Calculation always means that the reference is created to a severance pay process scenario that has already occurred. It is always first an initial calculation, and then later a retroactive calculation.

  • Selection list: Reason

    If the calculation type is Initial Calculation, you leave this field empty.

    Depending on the selection in the Calculation Type field, the reasons for the (renewed) calculation are provided here for selection. or example, in the standard SAP system for a retroactive calculation, this would be the new employer's objection to the severance pay calculation that was made.

  • Output field: Reference to Process

    The system fills the Reference to Process field with the existing retroactive pension insurance process scenario with calculation type Deferment for the first severance pay process scenario. The retroactive pension insurance process scenario with calculation type Deferment is displayed with the text 'Deferment' and the retroactive pension insurance period. Once this first severance pay process scenario with calculation type Initial Calculation has been released, you can create a correction of the severance pay in the form of a retroactive calculation as a new severance pay process scenario and then refer this to the previous process scenario with calculation type Initial Calculation using Reference to Process. The system depicts this connection automatically. Even for multiple severance pay process scenarios with calculation type Retroactive Calculation, the reference chain is depicted using the field Reference to Process back to the original retroactive pension insurance process scenario of the calculation type Deferment.

    It is not possible to enter a reference to a process scenario that is not yet released; in this case, the system cannot prepopulate either the field Calculation Type or the field Reference to Process and outputs an error message.
