Definition
In this field, you enter the start date from which the public holiday regulation is to apply within this agreement in accordance with the ruling of the Austrian Supreme Court (OGH) June 12, 1996 (9 ObA 2 060/96y).
In accordance with current legal information, public holidays that fall on a workday when an employee is ill must not be deducted from the entitlement quota laid down in the Continued Pay Act (EFZG) or the Salaried Employees Act (AngG). If an employee is ill on a public holiday and is entitled to pay for this day, the payment entitlement in accordance with the Rest Periods Act (ARG) takes precedence over any entitlement stipulated by the EFZG or AngG.
The public holiday regulation is only effective for those absence categories in the agreement to which you have also assigned a public holiday symbol in the relevant period in the 'Time-Dependent Entitlement Quotas' (V_T5A4D) view. If you have not entered a start date here (date from which the public holiday regulation will apply), but you have assigned a public holiday symbol in the view 'V_T5A4D', the public holiday regulation will apply as soon as the employee is entitled to the respective quota.
In the case of periods that lie before the start date specified here, the public holiday regulation will never apply even if a public holiday symbol is assigned to the absence category in the view 'V_T5A4D'.
