Definition

Specifies the respective, valid laws, agreements, directives and/or regulations that apply to foreign trade for a specific country.

In addition, different legal regulations may be required for the different foreign trade processes of a given country.

Use

The following legal regulations (for example) are valid in the individual foreign trade areas:

  • Import/export control
  • The legal import/export requirements are usually based on multiple directives and laws. Export regulations in the U.S., for example, re defined by the export regulations in the Export Administration Act (EAA) and the corresponding Export Administration Regulations (EAR). The corresponding laws in Germany are the Foreign Trade Administration Act (AWG) and the corresponding Foreign Trade Regulations (AWV).
  • Transit processing
  • Transit processing is regulated uniformly throughout Europe. The corresponding legal regulation bears the same name as the electronic system: New Computerized Transit System (NCTS).
  • Customs processing
  • Customs processing is the responsibility of the national customs authorities. The legal regulation for imports and exports in the U.S. is the Automated Customs Environment (ACE) (and its component Automated Export System (AES) for exports). The legal regulation for these processes in Germany is the Customs Codex (ZK) and its execution regulations (ZK DVO). Each customs authority has its own name for automated customs processing, for example, ATLAS for Germany and Sagitta for the Netherlands.
  • Preference processing
  • The conditions for preferential customs handling are regulated in unilateral, bilateral, and/or multilateral preference agreements between the European Union and partner nations. The blanket term for such regulations is "preference law".
  • Restitution
  • Subsidy payments by the European Union for CAP products are based on agreements in the European Common Agricultural Policy (CAP). They are summarized under the term "restitution".
  • Letter of credit processing
  • A letter of credit is an instrument used to balance the interests of buyers and sellers of goods in foreign trade. Letter of credit processing is based on the "Uniform Customs and Practices for Documentary Credits" (ERA 500) of the International Chamber of Commerce (ICC), Paris.

The valid legal regulation is determined for each combination of item and document.
