Definition

Specifies the relevant laws, agreements, regulations, and instructions that apply to a certain country's foreign trade. A country's various foreign trade processes may require different legal regulations.

Example

The following legal regulations, for example, are relevant in the individual foreign trade areas:

  • Legal control for import/exports

    The legal import and export regulations are generally based on multiple regulations and laws. In Germany, for example, they are divided between the AWG, the Foreign Trade Law, and the corresponding AWV, or Foreign Trade Regulation. In the United States, export regulations are defined in the Export Administration Act (EAA) and the corresponding Export Administration Regulations (EAR).

  • Transit processing

    Transit processing is handled uniformly throughout Europe. The corresponding legal regulation bears the name of the electronic system: New Computerized Transit System (NCTS).

  • Customs processing

    Customs monitoring is the responsibility of the national customs authorities. The legal regulation for imports to and exports from the United States is the Automated Customs Environment (ACE), which integrates automated export processing through the Automated Export System (AES). The legal regulation for these processes in Germany is the Customs Code (ZK) with its Executive Order (ZK DVO). They are named after the automated customs processing systems for the respective country, for example, ATLAS for Germany and Sagitta for The Netherlands.

  • Preference processing

    The conditions for preferential customs processing are regulated in unilateral, bilateral, or multilateral preference agreements between the European Community and its partner nations. Together, they are called "preference law".

  • Restitution

    Subsidy payments for CAP products by the European Community are based on the agreements defined in the Common Agricultural Policy (CAP). They are grouped together under the term "restitution".

  • Letter of credit processing

    The letter of credit is an instrument used to balance the interests of goods buyers and sellers in foreign trade. Letter of credit processing is subject to the "Uniform Guidelines and Rules for Documentary Credits (UCP 500)" as defined by the International Chamber of Commerce, Paris (ICC).

The relevant legal regulation is determined for each combination of item and document.
