Definition
Specifies the laws, agreements, regulations, and rules that are valid for foreign trade in a specific country. Different legal regulations may be necessary for various foreign trade processes in a country.
Example
In each of the areas of foreign trade, the following legal regulations, amongst others, are relevant:
- Import and export control
Legal import and export provisions are mainly based on multiple regulations and laws. In the Federal Republic of Germany, these are found in the German Foreign Trade Administration Act (AWG) and the corresponding German Foreign Trade Regulations (AWV). In the United States, export provisions are defined in the Export Administration Act (EAA) and the corresponding Export Administration Regulations (EAR).
- Transit processing
Transit processing is regulated on a Europe-wide basis. The corresponding legal regulation has the same name as the electronic system: New Computerized Transit System (NCTS).
- Customs processing
Customs supervision is the responsibility of the national customs authorities. The Automated Customs Environment (ACE) is the United States' legal regulation for import and export and incorporates automated export processing using the Automated Export System (AES). The legal regulation for these processes in Germany is the Customs Code (CC) and its implementing provision. For automated customs processing they are given a customs-specific name (for example, the Automated Tariff and Local Customs Processing System (ATLAS) for Germany). The equivalent in the Netherlands is called Sagitta.
- Preference processing
The conditions for preferential customs treatment are regulated in unilateral, bilateral, or multilateral preference agreements between the European Community and partner states. These are combined as a preference law.
- Restitution
The subsidies paid by the European Community for CAP products are based on agreements in the Common Agricultural Policy (CAP). These are grouped under the term 'restitution'.
- Letter of credit processing
A letter of credit is an instrument that is used to level the interests of purchasers and vendors of goods. The "Uniform Customs and Practices for Documentary Credits" (UCP 500) from the International Chamber of Commerce, Paric (ICC)" form the contractual basis for letter of credit processing.
The legal regulation that is valid is determined for the combination of item and document.
