Definition
With the agency, you define the legal regulation under which you perform a goods receipt for placement into customs status through a customs declaration with the customs authorities.
Use
- If you are a central department for customs handling within a company, you can make the customs declaration in your name, for example, but on the account of the goods recipient.
-> Indirect representation = The goods recipient is liable, not the importer
- If you manage import processing for a different goods recipient as forwarding agent or customs broker, you can do this in your own name and on your own account
-> Direct representation = Full liability of the importer (forwarding agent or customs broker); the goods recipient is not liable
- For simplified procedures or other procedures requiring customs approval - such as the customs warehouse procedure - the approval holder can only act in his own name and on his own account

Example of No representation and acting in own name within the EU with the single administrative document
Assume single administrative document 0737 contains Miller Inc. as recipient in field 8. Miller Inc. takes care of the customs declaration itself and enters itself in field 14 Declarant/Representative. Finally, Miller Inc. signs itself in 54 City/Date/Signature.
Example of Representation in name of and on account of the declarant (direct representation) within the EU with the single administrative document, as used generally in Germany, for example.
Miller Inc. hires forwarding agency WeShipIt to be the direct representative for the customs declaration. Single administrative document still contains Miller Inc. in field 8 as the goods recipient, but field 14 Declarant/Representative now contains "oB/oA the recipient/importer, WeShipIt, 555 Main Street, Anytown, PA 12345."
This means Miller Inc. is still responsible for the customs declaration and is solely liable for duties. WeShipIt merely takes care of the formalities on behalf of Miller Inc. The forwarding agent has to make its role as direct representative clear with the addition "oB/oA of the recipient/importer". WeShipIt signs in field 54.
Example of representation in own name, but on the recipient's account (indirect representation within the EU with the single administrative document (as used generally in France, for example).
WeShipIt now makes the declaration in its own name, thus accepting responsibility for the customs declaration, which means it becomes co-liable for duties together with Miller Inc. If something goes wrong, the forwarding agent bears the primary legal responsibility. In the single administrative document, field 8 still contains Miller Inc., but field 14 now contains "WeShipIt, 555 Main Street, Anytown, PA 12345. on the account of Miller Inc.". WeShipIt signs in field 54.
