Dedending on your own interpretation of the law, the deduction percentage corresponding to payments in kind can always be either the 'calculated percentage' or the 'applied percentage' if this is indicated as such in the 'Fiscal data' infotype (0062). The system leaves both options open.
In this IMG activity, you can choose the percentage you want to use in your company by assigning the corresponding value to constant PPAES.

Recommendation
SAP recommends you do not change the standard setting.
