Adjustment Allowance for Changes to Public Service Regulations

I. Legal Basis and Statutory Requirements

Basis for the adjustment allowance for changes to public service regulations is the First Public Services Regulation Reform Act for the State of Rhineland-Palatinate (1DRÄndG), for example. It describes a restructuring of the family-related bonus. Effective as of January 1, 2012, the spousal component is reduced and the children component is increased. Any reduction of payments caused by this is balanced out by an adjustment allowance.
The adjustment allowance decreases as follows until it is completely consumed:

  • Whenever linear adjustments occur, the adjustment allowance decreases by half of the increase amount.
  • Whenever other increases occur (with the exception of a change to the level of the family-related bonus), the adjustment allowance decreases by the full increase amount.

The linear adjustment on January 1, 2012 and other increases that occurred on January 1, 2012 both lead to the immediate consumption of the adjustment allowance.

Change of Family-Related Bonus

  • Spouse component
    The spouse component is reduced uniformly for all salary scales and salary groups to 60.00 EUR.
  • Child component
    The child component of the family-related bonus is increased to a uniform fixed amount for the first and second child. The component as of the third child is likewise increased on January 1, 2012, by 1 percent.

Adjustment Allowance

To avoid a reduction of payments due to the restructuring, an adjustment allowance is granted that compensates the difference between the new family-related bonus and the old family-related bonus.

  • Entitlement
    The entitlement to the adjustment allowance is coupled with the entitlement of the family-related bonus of level 1 in December 2011 and in January 2012. If the entitlement to the family-related bonus of level 1 does not apply once, then the entitlement to the adjustment allowance is no longer applicable and cannot be restored in the future.
    Therefore, the entitlement to the family-related bonus of level 1 must exist without any gaps since December 31, 2011.
    Interruptions or suspensions have no influence on the entitlement to the adjustment allowance. In addition, the entitlement no longer applies if the family-related bonus of level 1 is reduced after January 1, 2012, that is, if the entitlement changes from a full family-related bonus to half family-related bonus. However, a change on January 1, 2012 does not result in the loss of the entitlement to the adjustment allowance.
  • Calculation
    The adjustment allowance results from the comparison of the family-related bonus on the key date January 1, 2012 with the family-related bonus on the key date of December 31, 2011. For both calculations, the features (family-related bonus of level 1 and children data) are used generally on January 1, 2012. In the calculation, increase amounts for the child component in the lowest salary group are not taken into consideration.
    The department of the state of Rhineland-Palatinate regards the inclusion of only the features from January, thereby ignoring future changes such as the loss of a child, as possibly unconstitutional. Therefore the implementation should take into consideration that the calculation can also be performed using the features on the evaluation key date.
    The adjustment allowance is subject to the part-time reduction. The adjustment allowance is generally calculated on a fulltime basis and only reduced at the end according to the part-time when the adjustment allowance is paid.
    For the calculation, a minimal income threshold of 2.56 EUR based on the fulltime amount of the adjustment allowance must be taken into consideration. If the amount falls below this limit, there is no longer an entitlement to the adjustment allowance. The limit must also be taken into consideration for the consumption.
  • Consumption
    For payment adjustments, the adjustment allowance is consumed by 50 percent of the increase amount; for other increases (such as higher grouping or level increase), the adjustment allowance is consumed by the full increase amount.
    The sequential order of the consumption is relevant for the calculation if a payment adjustment and an other increase are to be taken into consideration at the same time. In this case, the other increase is to be determined first based on the values before the payment adjustment; then, in a second step, the increase due to the payment adjustment is to be determined based on the new salary features.
    Bonuses that accrue within the framework of a higher grouping (for example, service allowance) are taken into consideration for the consumption.
    Increases in the family-related bonus are not taken into consideration for increases in 2012. As of 2013, however, increases of the family-related bonus must also be taken into consideration. This also includes the change of entitlement of spouse component, that is, a change from half to full spouse component (increase from 30 EUR to 60 EUR) is taken into consideration in the full amount for the consumption of the adjustment allowance.
    Performance payments in the W salary are a certain percentage of the actual salary and are therefore likewise adjusted in proportion, thus leading to consumption.

Additional Requirements in the Pension

Within the pension, different calculations are made based on other salary features (for example, minimum pension with salary group A4). For the following calculations, the corresponding family-related bonus and the adjustment allowance are always to be determined as well:

  • Minimum pension A4
  • Upper limits
  • Pensionable pay from final level for the bonuses § 50 ff

The necessary enhancements are made depending on the public services regulation indicator 06 (Rhineland-Palatinate).

II. Implementation

The adjustment allowance is determined by a module of the indirect valuation.

Process Flow for Indirect Valuation

In the SAP standard delivery, the existing module DOZUL (Special Bonuses and Adjustment Amounts in Public Sector Germany) is used for the indirect valuation of the adjustment allowance, together with the (new) module variant B (Adjustment Allowance PS Employee Rhineland-Palatinate).

In the class CL_IM_HR_IV_DOZUL, the module variant is checked in the method DO_INDIRECT_VALUATION (Performance of Indirect Valuation) at the beginning of the method. For the new module variant B, the system calls the method CALCULATE (Determination of Adjustment Allowance) of the class CL_HRPADDE_IV_AUSGLEICHSZULAGE (Adjustment Allowance Rhineland-Palatinate).

In this class, the entire indirect valuation is performed. To enable inheritance for any necessary customer enhancements or standard developments, only instance methods are used.

All methods use the message handler IF_HRPAY00_MESSAGE_HANDLER.

The control parameters that are definitive for the calculation are saved as instance attributes of the class. The control parameters are set using the method SETZEN_STEUERUNGSPARAMETER. The method is the central point for controling the calculation that SAP or customers can use for future requirements when this method is redefined. The customer only needs to create a customer-specific module of the indirect valuation (new implementation of the BAdI HR_INDVAL), in which the customer-specific class that has to inherit from the SAP class CL_HRPADDE_IV_AUSGLEICHSZULAGE is to be called.

The control parameters are described in the following sections.
In the method CALCULATE, the checks and calculation described below are called.

  • Initialization: Method INIT

    For the initialization, the method INIT is called, in which the master data required for the calculation is provided. The method SETZEN_STEUERUNGSPARAMETER is also called.

  • Entitlement: Method ANSPRUCH

    The entitlement to the family-related bonus of level 1 (Spouse Component) must exist without gaps from December 31, 2011 until the day of the indirect valuation. The system evaluates the infotype Family-Related Bonuses (0595) for this.

    The following subtypes are relevant:

    • 1    Spouse component
    • 15    Spousal element (Partner)
    • 3    Spousal element (single)

      If a value not equal to SPACE or 0 is entered in the field Spouse Component, an entitlement exists for the spouse component.
      The system also checks whether the entitlement to spouse component changes from full to half. In this case, the entitlement to the adjustment allowance no longer applies.
