Under the Income Tax Assessment Act 1936, employers and other organisations are required to report to the Australian Taxation Office (ATO) details of employment declarations (including the tax file numbers (TFN) quoted by employees) lodged by employees during the reporting period.
Under the legislation, details of employment declarations must be reported to the Commissioner within a period of 28 days or such longer period as the Commissioner allows in a particular case.
The legislation also requires employers who have the capacity to store information on a computer to supply the information to the Commissioner of Taxation in a Form suitable for processing by the Tax Office Computer systems to store information.
Employers that lodge employment declarations with the ATO on magnetic media must ensure that the information is provided for each reporting period. Each report must include the declarations lodged during the reporting period only, that means the reports must not be "year to date".
