Use

The Employment of Minorities (Promotion) Act [Wet SAMEN] offers employers two different methods of determining whether or not an employee belongs to the target group specified under the act. Both methods use the countries of birth of the employee and his or her parents. Sometimes the employee's country of birth or the country of birth of his or her parent or parents may not be known. In such cases a decision is made on the available data.

  1. Automatic Method
If at least one of the three countries of birth (employee, mother or father) are classified as target group countries under the Employment of Minorities (Promotion) Act, the the employee automatically belongs to the target group specified by the Employment of Minorities (Promotion) Act.
  2. Limited Self-Identification Method
If all three countries of birth are/are not classified as target group countries under the Employment of Minorities (Promotion) Act [Wet SAMEN], it means that the employee does/does not belong to the target group of the Employment of Minorities (Promotion) Act. If one or two countries of birth are classified as target group countries under the Employment of Minorities (Promotion) Act, the employee is free to choose whether or not he or she wishes to belong to the target group of the Employment of Minorities (Promotion) Act.

The limited self-identification method has been incorporated into the Employment of Minorities (Promotion) Act as a conscession for those employees who object to being classified one way or another under the Employment of Minorities (Promotion) Act.

If you wish to offer your employees the limited self-identification method option, you must make it available to all your employees.
