Diagnosis

Under sec. 229 par. 3, cl. 3 SGB V, all capital benefits used for pension payments or surviving dependent's pensions, or as benefits in case of reduced earning capacity, are subject to contributions. Therefore, a capital benefit can only be created for pensioners. However, the person does not have status Pensioner in the specified period.
