Definition

Determines which law must be checked by the system:

  • If you choose "property date" the system checks the law that is valid in the year when the dismissal protection reason ends (property end date).
  • If you choose "firing date" the system checks the law that is valid in the year when the employee is fired.

Example

  • Related date: property date

    The employee was in the FGTS counsel (Premium Reserve Fund) until April 1999. The protection law valid in 1999 indicates that the employee is protected against dismissal for 6 additional months after the end of his duties as counselor. Since your system is configured to consider the law valid on the property end date of the dimissal protection reason, this employee is proteceted against dismissal until October 1999 (six additional month after he leaves his duties as counselor), independently of the firing date.

    Law in 2000: FGTS counselor has a six-month protection period

If the employee is fired after april 30, 1999 he or she is not protected.

  • Related date: firing date

    The employee was in the FGTS counsel (Premium Reserve Fund) until April 30, 1999 and is fired in February 2000. The protection law valid in 2000 indicates that the employee is protected against dismissal for one year after the end of his duties as counselor. If your system is configured to consider the law valid on the firing date, this employee is proteceted against dismissal until April 30, 2000, that is, he or she cannot be fired in February 2000.

Law in 2000: FGTS counsel has a twelve-month protection period
